RETREAT TERMS AND CONDITIONS

1. By taking any steps to participate in the retreat, including making an online reservation, processing payment for the retreat, or attending the retreat, you accept these Terms and Conditions as a binding agreement between Victoria Herczek (sometimes referred to as "VH") and yourself (hereinafter referred to as "you" or "I").

2. It is important for us to have a valid email address. If you change it, you should promptly notify us. We communicate via email. After making a reservation and receiving your deposit, all further correspondence will be conducted via email. We will also send you all the information you need to reach the retreat location through email. Additionally, we need a mobile phone number to contact you during your stay.

3. A fee of 100% of the price of the stay is charged upon booking and confirmation, unless a payment plan has been agreed upon in writing.

4. Travel costs are not included in the price, including flights and transportation from the airport through third-party transportation services (e.g., taxis, private cars).

5. The entire amount paid for the retreat is non-refundable, with no exceptions or refunds for cancellations for any reason. This includes any refunds or cancellations due to health issues, transportation problems, or force majeure. We recommend purchasing travel insurance. Please understand that the refund policy is in place because upon reservation, we commit to holding accommodations, meals, instructors, and other expenses for each participant of the retreat. You acknowledge that fees paid using an authorized credit or debit card are not subject to a refund by credit/debit card or chargeback after registration. By making a payment, you state that you are authorized to make payment using that card. If you later dispute the charges, you agree not to cancel, reverse, or dispute any previously processed charges on your credit card. If you do so and it is determined that the charge was properly authorized, you agree to pay all fees and costs incurred by VH as a result of improper cancellation, reversal, chargeback, or dispute.

6. VH recommends obtaining appropriate travel insurance, including coverage for medical expenses, accidents, repatriation, and cancellation. It is your responsibility to arrange or ensure that you have suitable comprehensive travel insurance, including coverage for illness, bodily injury, and trip delays/cancellations. We assume that such a policy is in effect before your departure, and you should carry the policy with you in case of an emergency.

7. Occasionally, we will take photos and videos during the retreat for our website, social media accounts (Instagram, YouTube, Facebook, TikTok), and promotional materials, including advertising. You consent to having your image captured and understand that all photos or videos taken are the exclusive property of VH. If you do not agree or wish not to participate in any photos or videos, please notify us in writing before or during the retreat. You agree to allow the use of any images, photos, or videos taken of you for advertising, promotional, and social media purposes and expressly waive any rights to privacy, compensation, copyright, or any other proprietary rights. All photos or videos are the exclusive property of VH.

8. VH is responsible for providing accommodations, raw or vegan meals each day during the retreat, movement classes, group mediation sessions, wellness workshops, daily educational talks, lessons and demonstrations, breathwork and group ceremonies.

9. Guests are solely responsible for any valuables left on the premises. VH is not liable for any loss, theft, or damage to personal items or property, including money, credit cards, or traveler's checks.

10. There are no refunds for any reason, including force majeure or inclement weather. Force majeure includes all extraordinary and unpredictable circumstances beyond our control, including but not limited to threats of war, riots, civil disturbances, strikes, technical problems at the facility, transportation issues, airport closures or congestion, terrorist activities, natural disasters, industrial accidents, fires, floods, and adverse weather conditions.

11. I agree to release VH from all liability for injuries, damages, claims, or causes of action arising from its negligence, including injuries or damages that may result from participation in any activities or exercises offered during the retreat or other improper or negligent acts or instructions. I fully understand that if any treatment is provided to me, with or without my consent, such treatment will be first-aid treatment, and I waive any claims or causes of action arising from or based on the provision of treatment, including treatment arising from negligence. This consent is not intended to waive claims for gross negligence or willful misconduct. I confirm that I have carefully read this waiver and release and fully understand that it is a release of liability. I waive any rights I may have to initiate legal action against VH for claims arising from its own negligence.

12. I agree that I engage in any activities during or throughout the retreat at my own risk (assumption of risk), including but not limited to movement, meditation, exercise, hiking, tours, swimming, and any other physical activities or use of any facilities on the premises. I acknowledge that participation in any activities offered by VH involves some risks, both known and unknown, including the risk of bodily injury. I am fully aware of the risk of injury involved. I hereby release V H and any affiliated companies, members, managers, directors, instructors, staff, agents, and co-participants from their own negligence and the duty of care to protect me from injury.

13. I agree to defend, indemnify, and hold harmless VH from any losses, damages, actions, lawsuits, claims, judgments, interest, penalties, expenses, attorney's fees, and costs of every kind arising from or related to personal injury, death, or property damage incurred due to or arising from my use of the facilities at the retreat or participation in any activities during the retreat. Upon arrival at the retreat, you will be asked to sign a document on terms similar to those outlined in this document. 14. This agreement is governed by law, and any actions arising from this agreement must be brought solely in the courts.

15. I agree and warrant that I will comply with all applicable laws, rules, and regulations.

16. If any provision or part of this agreement is found by a court of competent jurisdiction to be unlawful, void, or unenforceable, the remaining provisions or parts shall remain in full force and effect.

17. This agreement constitutes the entire agreement and supersedes all prior agreements, both written and oral, including advertisements or promotional materials on websites or social media. I waive any reliance on all prior statements. No changes, modifications, corrections, or amendments to this agreement shall be valid unless made in writing and signed by the parties. This agreement is binding and inure to the benefit of successors, assigns, and legal representatives of the parties.
